
The Supreme Court of Justice of the Nation confirmed the five-year prison sentence imposed on Facundo Denegri for the aggravated negligent homicide of Alberto Hambra, whom he ran over and killed in December 2018 in the Buenos Aires neighborhood of Puerto Madero. Denegri, who was 25 years old at the time of the accident, was driving his vehicle while intoxicated, under the influence of drugs, against traffic, and at over 100 kilometers per hour on Julieta Lanteri street. The victim, 75 years old, died on the spot.
Denegri's defense filed an extraordinary appeal before the Supreme Court alleging arbitrariness in the evaluation of evidence and the application of aggravating factors. The investigation revealed that Denegri carried alcoholic beverage containers in his car and 1.2 grams of marijuana, in addition to a blood alcohol level that was well above the legal limit.
The Criminal Oral and Correctional Court No. 5 had convicted Denegri for aggravated negligent homicide due to his reckless and illegal driving. The sentence included a special disqualification of ten years from driving vehicles. The tragic event occurred on the morning of December 22, 2018, when Denegri left the Buenos Aires Casino at the wheel of his Volkswagen Golf GTI.
However, the National Chamber of Criminal Cassation upheld the initial conviction issued in 2021, and now the Supreme Court has confirmed the sentence. Despite the appeal filed by Denegri's defense, the Supreme Court judges, Horacio Rosatti, Carlos Rosenkrantz, and Ricardo Lorenzetti, dismissed the claim for failing to meet the formal requirements established in the resolution 4/07.
